Mr. B, claiming that he urgently needed funds to participate in an investment venture, executed a promissory note with Mr. A. The note stipulated that Mr. A would lend: (1) NT$1,500,000 at an interest rate of 0.75% per month (9% per annum), (2) USD 10,000 at an interest rate of 1% per month (12% per annum), and (3) another NT$1,500,000 at an interest rate of 1% per month (12% per annum). Following the execution of the note, Mr. A duly disbursed the funds to Mr. B through wire transfers and other means.
After obtaining the loans, Mr. B invested the money but failed to repay Mr. A despite repeated demands and multiple promises to do so. Left with no alternative, Mr. A filed a lawsuit. Based on the legal relationship of a loan for consumption, the copy of the complaint served as a formal demand for repayment. Mr. A therefore sought full repayment of the amounts owed.
The New Taipei District Court rendered a final judgment ordering Mr. B to pay: (1) NT$1,500,000 with interest at 9% per annum, and (2) USD 10,000 with interest at 12% per annum. Litigation costs were to be borne by Mr. B. Following the court’s ruling, our firm filed for compulsory enforcement and facilitated mediation, enabling Mr. A to successfully recover the entire loan.
